This paper attempts to point out the risks of undermining the primacy of the Refugee Convention, and at the same time suggest various mechanisms or safeguards that may contribute to reducing the risk. Furthermore, the author discusses some issues that have to be settled in preparing the future community instrument, in terms of delimiting the beneficiaries of subsidiary protection and deciding the standards of treatment accorded to such persons.

This book is a compilation of research papers presented at a March 2001 workshop on ‘Refugee Education in Developing Countries: Policy and Practice’. The research papers presented here represent a step forward in the task of developing deeper professional insights into the field of refugee education and education in emergency situations in general.

This Opinion deals (1) with the applicable principles of international law, followed by (2) a review of the background to and scope of Articles 25, 27 and 28 1951 Convention; it then provides (3) a brief examination of selected State practice, (4) a summary account of current Canadian law and practice, and (5) an evaluation of that practice against the international standards established in the preceding paragraphs. It concludes (6) with a number of recommendations.
